Service terms at Maids by Trade

 

1.0 – Services, Scheduling and Appointments

1.1   Client has been provide with a list of service options from Maids by Trade.

1.2   Any cancellations must be done with AT LEAST 48 HOURS prior to the cleaning appointment, via email or in writing for any cleaning appointments. Failure to cancel within the 48-hour window will incur a late cancellation charge.

1.3   Our “3-hour window” means your scheduled cleaning team will be arriving anywhere within a 3-hour time frame window.

1.4   After agreeing to our Terms of Service, you authorize Maids by Trade to keep your credit card information under encryption if you, the client, chooses auto-pay for ongoing payment, or until all services rendered are paid for.

1.5   As the client, you agree to pay for services rendered at time of appointment with credit card provided or by check.

1.6   “Charged time” will start when the moment the team arrives and begins to unload their equipment and until the time ends when they depart the home.

1.7   We reserve the right to make the judgment of how many team members are required to complete a job.

1.8   Any changes or special instructions must be emailed or called into the office the business day, (24 hours) prior to the scheduled cleaning.

1.9   For the safety of our employees, Maids by Trade reserves the right to close our offices at any time.

1.10   Maids by Trade reserves the right to reevaluate rates and revise estimates provided at any time.

1.11   Maids by Trade employees make every effort to not damage, destroy, or harm any part of your property. In the event that your property is damaged, destroyed, or harmed by a Maids by Trade employee identical 1.1   replacement is always attempted but not guaranteed. For this specific reason, we request all irreplaceable items not be cleaned by our crew members.

1.12   For all claims, Maids by Trade must be notified within 24 hours of service, if damages are discovered.

1.13   Maids by Trade reserves the right to change and/or modify the Terms of Service at its discretion.

1.15   If client is not satisfied with our services, Maids by Trade must be notified within 24 hours of service.

1.16   If client needs to change an appointment, Maids by Trade will make every effort to accommodate the request, however we can’t guarantee availability.

1.17   Maids by Trade reserves the right to cancel a service appointment due to unforeseen events.

1.18   If property is in extreme condition and the job cannot be completed in one day, the job will be finished the following day. and the client will be notified.

1.19   Maids by Trade is not responsible for damages caused due to special instructions/procedures made by the client such as excessive mopping of wood floors, wiping walls, woodwork with chemicals, scrubbing stone work, etc.

1.20   Although Maids by Trade takes caution when using any cleaning products, Maids by Trade is not responsible for damages caused by cleaning products or equipment provided by the client.

1.21   Maids by Trade will not be held accountable for damages caused by faulty equipment/appliances provided by the client.

1.22   Maids by Trade is not responsible for damage due to faulty and/or improper installation of any items such as light fixtures; all surfaces (unsealed marble, granite, etc.) are assumed sealed and ready to clean without causing harm.

1.23   If we are specifically requested to clean/dust inside a china cabinet/hutch or dust any computer equipment, client agrees not to hold Maids by Trade or any of its employees responsible for damages to any article or component.

1.24   Arbitration of Disputes. In the event any claim or dispute, regardless of its basis, arises between Client and Maids by Trade, you as the client agrees to use the Better Business Bureau mediation and/or arbitration service.

1.25   Safety is an important matter, therefore all firearms in a client’s home must be stored and locked.

1.26   If a Maids by Trade team works six or more consecutive hours, the law requires them to take a 30-minute break.

2.0 – Service Charges and Other Fees

2.1   First, one-time, on-call and vacant property cleanings are billed by the hour in 15 minute increments.

2.2   Skipping scheduled regular weekly, every other week (biweekly), or monthly service will cause an adjustment to cleaning fee until client resumes regular service chosen.

2.3   Client will be charged a cancellation fee of $90.00 if cancelling or rescheduling without a full 48-hour cancellation notice via email or in writing for all cleaning appointments.

2.4   A $5.00 billing fee will apply if payment is not received at the time of service, unless other arrangements have been made with the office prior to the cleaning.

2.5   If a team can’t gain access to a job at the scheduled time, a $90.00 lockout fee will be assessed.

2.6   For service Monday – Friday Maids by Trade has a minimum requirement of 1.5 team hours for on-going & on-call service and a 4 man-hour minimum for First Time & Move In/Out cleanings.

2.7   For Saturday jobs, Maids by Trade has a 4 man-hour minimum for First Time & Move In/Out cleanings.

2.8   There is an additional $29.00 fee for Same Day Service and Weekend Service (where available).

2.9   All checks are subject to a $35.00 return fee (NSF). This fee will be added to the amount on the check and will be automatically charged to the credit card on file.

2.10   Unpaid balances will be billed a monthly finance charge of 2% per month (24% APR). In the event this matter is referred to an attorney, collections agent or small claims court, the client will be responsible for court costs, attorney fees, and/or collection agency fees. In addition, there will be a $10.00 certified mail fee every time a collection letter is mailed to the client.

3.0 – Default/Termination

3.1   Maids by Trade requires a full 48-hour cancellation notice via email or in writing for any cleaning appointments.

3.2   If Client is in default of these Terms of Service for failure to pay any fees, charges or other amount when due, fails to perform any of Client’s other obligations under these Terms of Service, and such default continues for 10 days after Maids by Trade gives Client written notice, in addition to any other remedies provided by law, Maids by Trade may do any or all the following without releasing Client: termination of these Terms of Service upon 10 days’ written notice to Client.

3.3   In the event that Maids by Trade chooses to enforce its rights, Maids by Trade is entitled to recover all reasonable collection expenses, court cost and attorney’s fees at trial, on or appeal, or in connection with any petition for a review.

3.4   If a court determines that any provision in the entire Terms of Service is invalid or unenforceable, that provision will be null to the extent determined by the court, however, every other provision in the entire Terms of Service will continue to be valid and enforceable.

3.5   Maids by Trade reserves the right to assign its rights under these Terms of Service and/or delegate any obligation or subcontract any service performed here without notifying Client. Client may not assign Client’s rights or delegate Client’s obligations under these Terms of Service without Maids by Trade’s prior written consent.

3.6   The laws of the State listed as the Service Address govern the validity, enforceability and the interpretation of these Terms of Service.

 

4.0 – Arbitration Disputes

4.1 In the event that any claim or dispute arises between Client and Maids by Trade for any reason, Client or Maids by Trade may elect to resolve the claim or dispute by binding arbitration. IF EITHER CLIENT OR MAIDS BY TRADE ELECT ARBITRATION, NEITHER CLIENT NOR MAIDS BY TRADE SHALL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR TO HAVE A JURY TRIAL ON THAT CLAIM. FURTHERMORE, PRE-HEARING DISCOVERY RIGHTS AND POST-HEARING APPEAL RIGHTS WILL BE LIMITED. NEITHER CLIENT NOR MAIDS BY TRADE SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER CLIENTS WITH RESPECT TO OTHER ACCOUNTS, OR ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The filing of a lawsuit by any party shall not constitute a waiver of any rights under this arbitration provision. We will not invoke our right to arbitrate an individual claim you bring in small claims court.
